In these terms and conditions the following terms shall have the following meanings:
Supplementary agreement: an agreement whereby the consumer acquires products, digital content and/or services in connection with a distance contract and these goods, digital content and/or services are supplied by the entrepreneur or a third party on the basis of an agreement between that third party and the entrepreneur; Consumer: the natural person who is not acting for purposes relating to his trade, business, craft or profession; Right of withdrawal: the option for the consumer to cancel the distance contract within the cooling-off period; Entrepreneur: the natural or legal person who offers products, (access to) digital content and/or services at a distance to consumers; Distance contract: an agreement concluded between the entrepreneur and the consumer within the framework of an organised system for the distance selling of products, digital content and/or services, whereby up to and including the conclusion of the agreement exclusive or partly use is made of one or more techniques for distance communication;

Article 3 – Applicability
These general terms and conditions apply to every offer from Bestbud.nl and to every distance contract concluded between Bestbud.nl and the consumer. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, the entrepreneur will indicate before the distance contract is concluded how the general terms and conditions can be consulted with the entrepreneur and that they will be sent free of charge as soon as possible at the consumer's request. If the distance contract is concluded electronically, notwithstanding the previous paragraph, and before the distance contract is concluded, the text of these general terms and conditions may be made available to the consumer electronically in such a way that the consumer can easily store them on a durable data carrier. If this is not reasonably possible, the entrepreneur will indicate before the distance contract is concluded where the general terms and conditions can be consulted electronically and that they will be sent free of charge at the consumer's request, either electronically or otherwise.
Article 4 – The offer
If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.
The offer contains a complete and accurate description of the products, digital content, and/or services offered. The description is sufficiently detailed to enable the consumer to properly assess the offer. If Bestbud.nl uses images, these are a true representation of the products, services, and/or digital content offered. Obvious mistakes or errors in the offer are not binding on Bestbud.nl. Each offer contains sufficient information to clearly indicate to the consumer the rights and obligations associated with accepting the offer.
Article 5 – The Agreement
Subject to the provisions of paragraph 4, the agreement is concluded upon acceptance by the consumer of the offer and compliance with the conditions set therein. Bestbud.nl may, within legal frameworks, investigate whether the consumer can meet their payment obligations, as well as all facts and factors relevant to responsibly entering into the distance contract. If, based on this investigation, the entrepreneur has good reason not to enter into the agreement, they are entitled to refuse an order or request with reasons or to impose special conditions on its execution.
Article 6 – Exclusion of the right of withdrawal
Bestbud.nl can exclude the following products and services from the right of withdrawal, but only if the entrepreneur has clearly stated this in the offer, at least in good time before the conclusion of the agreement: Products manufactured according to the consumer's specifications, which are not prefabricated and which are manufactured on the basis of an individual choice or decision by the consumer, or which are clearly intended for a specific person; Products that spoil quickly or have a limited shelf life; Sealed products which for reasons of health protection or hygiene are not suitable for return and of which the seal has been broken after delivery; Products which after delivery are inseparably mixed with other items due to their nature;
Article 7 – The price
During the validity period stated in the offer, the prices of the products and/or services offered will not be increased, except for price changes due to changes in VAT rates and shipping costs. The prices stated in the offer for products or services exclude shipping costs.
Article 8 – Compliance with the agreement and additional warranty
Bestbud.nl guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability, and the legal provisions and/or government regulations in force on the date the agreement is concluded. If agreed, the entrepreneur also guarantees that the product is suitable for other than normal use.
Article 9 – Delivery and execution
The entrepreneur will exercise the utmost care when receiving and fulfilling product orders and when assessing requests for the provision of services. The place of delivery is the address the consumer has provided to the entrepreneur. Subject to the provisions of Article 4 of these general terms and conditions, the entrepreneur will fulfill accepted orders expeditiously, but no later than within 30 days, unless a different delivery period has been agreed. If delivery is delayed, or if an order cannot be fulfilled or can only be partially fulfilled, the consumer will be notified of this no later than 30 days after placing the order. In that case, the consumer has the right to terminate the agreement free of charge and is entitled to any compensation. The risk of damage and/or loss of products rests with the consumer until the moment of delivery to the consumer or a previously designated representative announced to the entrepreneur, unless expressly agreed otherwise. Deliveries to countries other than the Netherlands are only made for certain products. In addition, the delivery time to countries other than the Netherlands is longer. For the exact delivery time, please contact our customer service. Standard shipping: the risk lies with the customer. Bestbud.nl always ships. If the shipment does not arrive in this case, the risk lies with the customer, and Bestbud.nl cannot be held responsible.
Article 10 – Payment
The consumer is obligated to immediately report any inaccuracies in the payment information provided or stated to Bestbud.nl. Unless otherwise stated in the agreement or additional terms, the amounts owed by the consumer must be paid before shipping the products. By accepting the Terms and Conditions, the consumer declares that they have read and understood the payment options.
Article 11 – Complaints procedure
The entrepreneur has a sufficiently publicized complaints procedure and handles complaints in accordance with this procedure. Complaints about the performance of the agreement must be submitted to Bestbud.nl fully and clearly described within a reasonable time after the consumer has discovered the defects and within two weeks of receiving the order. If no order has been received, notification of non-receipt must be submitted within 7 days of placing the order. Complaints submitted to the entrepreneur will be answered within 14 days of the date of receipt. If a complaint requires a foreseeably longer processing time, the entrepreneur will respond within 14 days with a confirmation of receipt and an indication of when the consumer can expect a more detailed response. The consumer must give the entrepreneur at least four weeks to resolve the complaint by mutual agreement.
Article 12 – Additional or deviating provisions
Additional or deviating provisions from these general terms and conditions may not be to the detriment of the consumer and must be recorded in writing or in such a way that they can be stored by the consumer in an accessible manner on a durable data carrier.
Customers must be at least 18 years old. Bestbud.nl makes every effort to prevent customers under 18 from ordering from us. Orders can only be placed if the customer indicates they are 18 years or older. If there is any doubt about the customer's age, Bestbud.nl will randomly contact the customer in question. Bestbud.nl reserves the right to cancel an order and issue a refund.
Article 13 – Privacy
Our customers' privacy is important to us, and we ensure it is protected. We delete payment information 72 hours after the order arrives, and we store no other data (except when creating an account). Customers are free to create an account on our website to place orders. While this information is stored, we have no further access to it. If you want your account deleted, please contact our customer service. We do not use personal data for anything other than delivering orders and communicating with you via email.
Disclaimer:
Bestbud.nl does not directly own or sell weed, hash, or other products. We (Bestbud.nl) only handle the collection and shipping of products for customers. For this service, which is fully in partnership with several Dutch coffeeshops, we (Bestbud.nl) receive a small commission. Therefore, we (Bestbud.nl) do not "resell" anything.
We (Bestbud.nl) reserve the right to cancel orders if, in our opinion, an individual is ordering too frequently. Our services are intended solely for recreational use, not for bulk sales and/or wholesale. In the event of a cancellation, you will be contacted by email and payments will be fully refunded.
